How to File a Takedown Notice

Send an email to newslegalcollections@gmail.com with “DMCA” in the subject line. Under 17 U.S.C. § 512(c)(3), your notice needs to include:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you say was infringed.
  3. Identification of the allegedly infringing material on our site, with a URL specific enough that we can find it.
  4. Your contact information — name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Incomplete notices may not be processed. If you are not sure whether you have all of the above, send what you have and we will follow up.

What Happens After You File

We review every notice promptly. If the claim has merit, we will remove or disable access to the material and notify the user who posted it. Depending on the situation, we may also reach out to you for additional information before taking action.

Counter-Notices

If your content was removed and you believe the removal was a mistake or misidentification, you can file a counter-notice. Send it to the same email address with “DMCA Counter-Notice” in the subject line. A counter-notice needs to include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any federal judicial district in which we may be found), and a statement that you will accept service of process from the person who submitted the original notice.

If we receive a valid counter-notice, we will forward it to the original complainant. The material may be restored within 10 to 14 business days unless the complainant files a court action seeking to restrain the counter-notifying party.

Repeat Infringers

We terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances, consistent with 17 U.S.C. § 512(i).

False Claims

Misrepresentations in a DMCA notice or counter-notice can result in legal liability. Section 512(f) of the DMCA makes you liable for damages, including costs and attorney’s fees, if you knowingly misrepresent that material is infringing or was removed by mistake. Please consider this before filing.
